Roundup Class Action Suit is Going National!

Attorney T. Matthew Phillips recently announced a shift in his LA County Class action suit against Monsanto’s Roundup for false advertising. The lawsuit defendants have the choice of court venue while plaintiffs choose the geographical location of the court. So now the defendant Monsanto’s attorneys have chosen to move the suit from L.A. County Court to a California federal court.

So instead of only California residents, this class action suit will now involve anyone in the whole nation who has purchased Roundup during the last four years. It’s not a personal injury suit. It’s a valid false advertising claim. If all goes well with the false advertising suit, a personal injury class action legal claim may ensue, according to Phillips.

As pointed out in a previous article that announced the L.A. County class action suit for Californians only, Roundup labels have the following prominent text: “Did You Know? Glyphosate targets an enzyme found in plants but not in people or pets.”

That claim has been scientifically determined to be completely false. Here’s the original L.A. County filing. Apparently, this decision to use a federal court is a move by Monsanto as defendant to avoid state by state lawsuits from cropping up and spreading if Phillip’s suit were to succeed in California.

The federal court’s decision, whichever way it goes, will keep that from happening. One the other hand, Phillip’s suit is now open for everyone in the nation who has purchased Roundup in the last four years, not just Californians.

Why the Roundup Label is False

The enzyme Roundup targets is EPSP glyphosate synthase. But it’s not just in plants, it’s in humans and animals. This enzyme is part of the human gut microbia. It’s part of what the gut needs for digestion and to perform as a major part of our immune system.

Destroying that enzyme inhibits probiotic microbe colony life, leading to serious digestive issues such as Crohn’s and IBS (irritable bowel syndrome) as well as impairing our natural immune systems now and causing even more potential harm to future generations.

Roundup’s glyphosate and its added ingredients that make it easily absorbed through plant tissue more effectively have been discovered by France’s Seralini and other researchers to create a biocide that permeates and kills everything in its path in the soil and causes damage to animal and human organs.

You can’t remove Roundup’s herbicidal residue from you food. It’s effectiveness comes from thespraying large field plants absorbing it into their cellular tissue. But you can wind up eating it even if you are avoiding GMO plant foods. Glyphosate is often used on non-GMO grains to desiccate (dry out) grain crops and permit earlier harvesting.

Mainstream Media Blackout on This Roundup Suit

Efforts to publicize the original suit filed in Los Angeles County on April 20, 2015 have been rejected by the LA Times, NY Times, Huffington Post, CNN, and Reuters, one of the world’s largest news agencies. Attorney Phillips, has been posting the suit in Wikipedia’s Monsanto litigation section, but it keeps getting removed.

T. Matthew Phillips is the first private attorney to file a lawsuit against Monsanto for false advertising, and he the current plaintiffs need funding to get through all three phases to bring the suit to trial.

Phillips can’t understand why both the California and Nevada Attorney’s General are not picking up on his action against Monsanto. Phillips said that they both got angry with him for suggesting they do.

In 1997, New York’s Attorney General (AG) ordered Monsanto to pull ads declaring Roundup “safer than table salt” and “will not wash or leach in the soil” and “will not generally cause unreasonable adverse effects on the environment” as well as other claims. Monsanto pulled the ads and no fines were levied.

Not so 10 years later, 2007 in France. For similar reasons as the New York AG’s action, France got 15,000 euros (19,000 USD) from both Monsanto and it’s French distributor. Monsanto appealed twice and both appeals were refused by 2009. A slap on wrist, but more public exposure on Roundup LawsuitRoundup’s toxicity and Monsanto’s duplicity.

The WHO has recently announced Roundup is “probably carcinogenic to humans”. This has been publicized and revelations have surfaced that the EPA and Monsanto knew of Roundup’s carcinogenic toxicity for decades. Monsanto’s Roundup is the largest selling herbicide in the world, and almost all their GMO crops are designed to withstand it.

It seems obvious that attacking Roundup in every way possible now is the best way to fight back against this major toxic chemical company that’s attempting to control the food supply while poisoning us. You can access the Roundup lawsuit site here.
